You’ve likely heard of chief justice of Alabama’s Supreme Court Judge Roy S. Moore…. Yes, THAT ‘Roy Moore’. The one who said probate judges have a “ministerial duty” to comply with Alabama’s supposed-ban on same-sex marriage, apparently in DIRECT conflict with the SCOTUS ruling on ‘Obergefell v. Hodges’ aka ‘Mariage Equality’. His reasoning? The SCOTUS ruling that state laws in Kentucky, Michigan, Tennessee and Ohio that defined marriage to be only a union between one man and one woman were unconstitutional; that ruling ONLY affected Kentucky, Michigan, Tennessee and Ohio – NOT the whole of the U.S., and most definitely did NOT affect his home state of Alabama.
So we’re going to talk about who has the highest authority when it comes to court cases, and what the rhetoric term, “Legislating From The Bench” means.
